The
officers of a non-governmental organization in Bohol filed
an anti-graft case against a labor commissioner of the National
Labor Relations Commission (NLRC) - 4th division of Cebu City.
Dr.
Virginia Lao, Benjamin Escobia and Hercules Paradiang, officers
and members of the board of trustees of Feed the Children
Philippines Inc. (FTCPI) based in Tagbilaran City, Bohol asked
Acting Deputy Ombudsman for the Visayas Director Virginia
Palanca-Santiago to investigate Commissioner Oscar Uy for
possible violation of the anti-graft and corrupt practices
act.
The
case stemmed from a complaint for illegal dismissal filed
by the former national director of FTCPI, Rosalinda Paredes,
in the Tagbilaran branch of the NLRC.
In
a Nov. 8, 2006 decision, the labor arbiter ordered the complainant
(Paredes) to pay P1 million as damages to Lao, Escobia and
Paradiang.

They
said Paredes appealed the case, which was being handled
by the sala of Commissioner Uy.
The
assignment or referral of the case did not go through
the normal raffling process "such that Commissioner
Uy pulled out said case records from the docket section
of the NLRC 4th division," they alleged in their
joint affidavit dated April 23.
The
complainants said that on April 4 they learned that
the Commissioner had reversed the decision issued by
the NLRC-Tagbilaran.
They
said Uy arrived at a decision within eight working days
despite the voluminous record of the case, which consisted
of 1,228 pages.

"We
consider that the decision penned by Commissioner Uy to be
highly irregular and anomalous and the circumstances surrounding
the resolution of the aforementioned case questionable, which
our belief is tantamount to serious violations of the code
of judicial conduct and more importantly, RA 3019 or the anti-graft
and corrupt practices act," they said. (Cebu Daily News)
