Embattled Albur
Mayor Jose Ugdoracion has nine days left to secure a certiorari
on the Comelec en banc ruling which disqualified him as a
candidate in the May 14 elections.
Ugdoracion told the Chronicle yesterday that the Supreme Court
will start hearings on his motion for writ of certiorari and
prohibition this Tuesday.
Although
he failed to get a temporary restraining order (TRO) on the
prescribed deadline last Monday, Ugdoracion said the Comelec
en banc will not issue a writ of execution to implement its
ruling until his pending motions at the high tribunal is resolved.
Starting
last Monday, however, the mayor-elect has to get the Supreme
Court's decision within 15 days, or until October 30.
Otherwise,
the Comelec decision will be implemented and Ugdoracion will
be removed from his post.
The
mayor was disqualified by the Comelec en banc as a candidate
in the May 14 elections due to lack of one-year residency.

In
a separate interview, former mayor Efren Tungol, father
of mayoralty candidate and petitioner Ephraim Tungol,
bared that their lawyers already filed for the issuance
of a writ of execution at the Comelec Manila last Monday
after learning that Ugdoracion failed to secure a TRO.
The
former mayor expressed confidence that the Comelec will
grant their request for a writ of execution since not
even a certiorari was issued by the Supreme Court that
could have prevented the poll body from implementing
its decision.

WHO
WILL SUCCEED?
On
the event that Ugdoracion will be removed from his mayoralty
post, two legal opinions surfaced as to his successor.
Vice
Mayor Cirilo Jalad, who is the second highest elected official
can assume as mayor of Albur.
However,
the Tungol camp issued a statement that because of the circumstances
behind the matter, Ephraim Tungol, who got the second most
number of votes in the mayoralty race last May 14 holds the
jurisdiction to assume the vacated post.
